Don't know about your court systems but in Alabama if you plead your case as best you can and then show whatever supporting documentation you have but still are cited then you can ask the judge for leniency in the form of community service. I've had a lot of my friends spend a Saturday raking leaves or picking up trash at a city park and about their only expense is court cost (about $150.00). In other words for a little community service they waive the charges and fines. Worth a try instead of just paying the fine.

This seems a poor reason to bob a deuce, but it would probably prevent future problems.

Getting your deuce legal in the respects to your citation/ticket and going to court with it you could maybe play the "I didn't know about XX laws, but I've fixed it and would like you to pretty please dismiss it. I promise to be a good boy" ploy.

Okay guys here is what I found out for the NC guys.

The weight

We can still run antique tags on our trucks BUT we must go and purchase additional weight and have it assigned to our tag. As long as you have enough weight assigned to your tag to cover the weight of the truck and whatever you ,might be hauling then you are golden. end of story on that one.

A NC fuel decal.

I spoke with the NC motor fuel tax guy, and he said that because the deuce is a tri-axle truck we must apply for a NC fuel decal. He said that the NC fuel decal is free but we must still apply for one. you can apply for one here... www.dornc.com

If you plan on running your truck out of the state of Nc then you must either purchase a IFTA decal or buy a temporary out of state fuel decal. The out of state decal is only good for three days and can be purchased for $50.00.

Alternative fuels

The fuel guy told me just to be safe it would be best to just stay away from ATF because he believes that the same red dye used in off road diesel is used to dye the ATF, so if you get stopped then there is a good chance that the test results will come back as off road diesel. Now, he told me to send him a sample of the ATF that I want to use and he will test it to be sure, but for now it is not a good idea.

As far as running other products he told me that we can run them but we have to report how much we use and pay the fuel tax on it. He said that the going rate for fuel tax right now is 30.55 cents a gallon. If you want to use alternative fuels then you have to fill out a "gas 1259" form and send in a check for the tax. As long as you have the form in the truck along with a copy of the cashed check then we are good to go if you get stopped and have your tank dipped.

As I have stated above I am going to challenge the citation that was issued to me, so wish me luck.

does that mean every time you brew up a batch of alternative fuel, you have to pay and keep a copy of the check/form or can you pay once a year at tax time but keep current records with you of brewing and use from 15 Apr last year to the present (15 Apr this year)..?

and the going rate he quoted @ 30.5 cents per gal..is that state plus fed or ? and the requirement to pay both, etc..

Just think, some pencil $#@ ahole wrote those laws to keep us from creating more global warming? or was it to pay for their private jets to fly from DC to California every week...???

I own a Deuce therefore I will drive it when I **** well please!!!

Not sure about the fed taxes.... I was told that you pay the taxes every month on the 22nd.

I forgot to mention this but if you are making and burning your own bio diesel then there are no taxes, fines or anything else, just make it and burn it.

I thought you would still be subject to a 'road tax', maybe not fuel taxes however.. I always used to see truckers with signs on the back of their rig..'This truck pays $xxxx a year in road tax.." maybe just a different term for fuel taxes? Do you have the code section that says no tax for bio-fuels, by chance? just curious..

Sorry, but I dont know the section/law that says you dont have to pay. I am just going off of what the motor fuel tax officer said.

The rules for GA are as stated on the DOR website:

"III. Who Needs an IFTA License?
  1. Any qualified motor vehicle engaged in interstate commerce that is based in Georgia and is not IFTA registered in another jurisdiction must register and file reports and payments covering all jurisdictions with Georgia.​
    A qualified vehicle is one designed or maintained to transport persons or property which:
    • Has tow axles and a gross vehicle weight or registered gross vehicle weight exceeding 26,000 pounds or 11,797 kilograms.
    • Has three or more axles, regardless of weight
    • Is used in combination when such combination exceeds a gross vehicle weight of 26,000 pounds or 11,797 kilograms
    The following vehicles should not register with the Motor Fuel Tax Unit: school buses; federal, state or local government vehicles; transit buses; and other qualified vehicles used exclusively within Georgia. Additionally, Recreational Vehicles such as motor homes, pickup trucks with attached campers, and buses when used exclusively for personal pleasure by an individual are exempt."


    Still looking for info on a fuel decal. Historic tag covers Duece. Later model trucks are issued tags with weight class (ie-mine are 18K).

The alternative fuel issues reminded me of back in the day (mid 80's)when I had an STC on my Pawnee spray plane so I could legally (by the FAA)burn automotive gas rather than Av-gas.State of Idaho had a form to fill out so you could get tax credit BACK because the fuel burned did not use highway miles.

i have a regular passenger plate on my deuce, not antique. I've been pulled over once, for running a stop sign. Was given a verbal warning and nothing was said about weight. However, I do know that the passenger tag is good for 7,000 lbs, and i believe you are allowed to tow up to total of 9k combined, so i figure i'm only 5K over empty. No worries for me since i only haul my fat butt around. To fix the problem of weight, i am in the process of getting mine "converted" and titled as an RV. Then there is no weight limit, and I can tow in excess of 26K without a problem.

Is the antique tag cheaper than regular? Also, since your deuce is 35 years or older, run an actual antique plate on it (plate from the year your deuce was made) and keep your real license plate in the cab to show whenever you are pulled. The numbers on the plate don't go to you, and you can't tell from looking at it if it's weighted since in the 70's they didn't do that. Then you can also get parking tickets or blow the redlight cams with no worries of ever getting a ticket. I did learn that the one 1972 plate i have, the numbers are actual #'s being used on a current plate and registered like 2hrs away to a gravel company. Cop on the beach seemed suprised that i would drive that far, and it tool me forever to explain that the tag on the back is just the antique tag and my real one is in the glovebox, completely different #s.

[HB 704 was passed into law May 24, 1985 and amended G.S. 20-63(d). This bill allows owners of motor vehicles, 35 years or older, to display an 'antique' license plate which displays the year of manufacture. A current plate must be purchased and kept inside the vehicle.]

I agree: We spent two years in NC and I have never been taxed so much in my life. Everything from food at the store to the rain water running off of our roof. We took the first opportunity we could find to get out of North Carolina. I will never go back.

Just depends on what part of NC you live in. I'd rather someone shoot me as to have to move to California. At least we don't need a CDL to drive a deuce here. :)

I agree: We spent two years in NC and I have never been taxed so much in my life. Everything from food at the store to the rain water running off of our roof. We took the first opportunity we could find to get out of North Carolina. I will never go back.
Taxes aren't bad here... and we don't miss those that leave... :)
