Reading this thread, I finally realize what motivated our Wisconsin DMV to want to outlaw ex-military vehicles. If they can manage to keep milvehs off Wisconsin roads, then the drunks won't have things to crash into. Drunk driving problem solved, and all thanks go to the WisDOT.

I also appreciate now why it was so important to our DOT to make it a legal requirement to keep any privately-owned milvehs in their original military paint scheme. Highway safety!! Stupid me, I always imagined that the reason milvehs were painted camo was to make them more difficult to see, thus the name "camouflage". But again, I bow to the superior intellect of those geniuses at WisDOT.

I'd say there's a fair chance she didn't have any insurance. If she does, sometimes insurance companies don't like to pay out when they are drunk behind the wheel. She violated the terms of her agreement with her insurance company when she decided to drink and drive. All I can say is, good luck.

The bright side is, it looks as if there is no more than a couple of hundred dollars damage to your truck.

They're almost fanatical about it. When I registered my VW Bug, the insurance was still set for La. Got a big nasty gram in the mail. Got it fixed. Found the nice person at the DMV that day.

she had a valid license and insurance, the officer would not give any of it to me, said I would have to call my insurance company on Monday and file a report, and that they would request a copy of the police report and procede from there. I'm still calling the sherrifs office on Monday requesting my own copy too. I'm assuming due to the condition of the car she probaly has an el-cheapo insurance company, so I know I am in for a run around. I only have basic liability from Gulfway, so I do not expect anything from them either.

The one good side is MD publishes online every criminal or civil court case, so by Monday afternoon, I will have her information either way. I looked back over the truck and can not see any visible damage, it appears her wheel came up over my wheel and kept going, the first tire has a decent scuff, much like running it along a curb. the tire with the bent rim has a small cut where her rim ran along it so that tire is toast in my book. Generaly speaking, abuse wise, it is probably no worse then a good off roading trip over some decent rock.

From what my neighbors have told me, when her husband showed up he told the officer that she had been wanting cigerettes all night and he told her that he wasnt getting them for her and that she was to drunk to drive. she left anyways. so all of this over a pack of smokes.

Be careful about posting accounts of the wreck. The insurance company might try to use it against you. First thing, don't tell them about steel soldiers. It seems cut and dry about what happened but insurance companies can be very slippery. Glad you're ok. Glad your truck is ok too.

She was drinking and driving ....Don't let the insurance try to pull one over on you..It is her fault....They will pay for a new tire,rim tube ,flap mounting and balancing....Also at the bear minimum i would have an alinement done ...check everything in the rear suspension.The u-bolts are ussually rusted and may be bent from the impact.

Whiteford is in Harford County, correct? Did the Harford County Sheriffs department do the investigation or was it the Maryland State Police?

Under Maryland law, drivers involved in an accident are required to present thier drivers license and registration unless medically unable. If Barney Fife told you different he would have been lieing to you. File a complaint against him unless he changes his tune. The police report is going to cost you. They used to be $10, don't know they cost today.

Drunk driving or not, her insurance is responsible for any damages. Calling your insurance company is a good thing as they won't be able to say at a later date that you did not make notification. If her insurance balks, Gulfway will pay the claim and go after her insurance. The sometimes beauty of no fault insurance.

Judical Case search is a good resource isn't it?

In this case he will have to wait for the report as this is the policy of the Harford County Sheriffs office, as I learned a few years ago. I think a copy of the report is $5 payable by CHECK only so bring the checkbook.

I have had several hits to my person and vehicles by bad drivers.

Any tires that have been hit are BAD.. A deuce uses HD truck tires and any hard hits or gashes will make the sidewall dangerous when heavily loaded. so make them pay for new NDCC's:evil:

If the rim is bent it should be replaced or straitened by a HD truck wheel specialist.

The truck needs its rear axle shafts checked for straightness and the rear axle housings realighined ..

I would get several estimates if possible. and don't take No for and answer from the Insurance company.

By law they have to make you whole, no matter how hard they squirm!

I am in Kansas, obviously, but with 27 years on the local PD, Kansans have forms to fill out at the scene for the other driver, an insurance exchange. I cannot imagine an officer denying you any information you wanted to obtain at the scene, except facts relating to the criminal DUI investigation and those should have been visible at the scene.

In Kansas her insurance company would have to fix your truck to its previous condition. Unfortunately they hire squirmy worms to try to save the company as much money as possible. Keep a stiff upper lip and tell them you want it fixed to the condition it was previously.

When my first M1008 got destroyed, the first words out of that adjuster's mouth was that it was a 1500 dollar truck. I told him I did not think so and started printing Ebay sales ads as they closed. At that time a really nice M1008 was bringing 6500 and about any of them that ran and were not rust buckets brought 2500. I told him my truck was about a 4500 dollar truck on the date of the accident and they could fix it or find me another equivalent truck.

We settled for 4500 and I offered to buy the truck back, which I did, at their offered price of 600 dollars. It sold on Ebay wrecked for 4325 with two 8000# winches on board and an extensive set of service and repair records. Glen

I realize that this may or may not be the same in MD but in NYS, you are required to furnish the other driver(s) with your name, address and insurance information whether an accident was your fault, theirs, or who knows....I suspect an improper procedure in that the officer did not furnish you with her insurance information.

Perhaps he did not want her to talk to you as she was drunk and he did not want to taint his case of dui against her in any way. Not sure otherwise.....

The woman's insurance will be liable for your damages regardless of her being DUI. Her insurance may not cover any of her damage depending on the wording in her policy.

Contact your insurance and fill out any accident reports that they request. This protects you from her insurance company claiming your responsible for part of the damages due to the MV you drive.

In NYS they apportion liability and even if you are hit and it is slam dunk the other guys fault, your company will settle the case 90-10 with your being 10% at fault for simply being there. It sucks and I would bet MD has the same policy regarding liability.

If this were me, I would attempt to deal for the damages to my vehicle with her insurance myself, and keep my insurance out of it. They like it when they do not have to send a claims adjuster out as it costs them a lot of money even for a small accident.

Two tone bright blue and flat black krylon primer , real classy chick . I just paid $100 for 7 rims and tires . I would not repair that rim . You have the option of going through your insurance co and letting them go after her ins. co . if her ins. gives you problems .

Thank you all for the sound advice, I now have a solid list of "requests" to ask the insurance company for tommorow when I call them. I do have to say the deputies were very nice to me and in fact were quite in love with the truck.

I believe the driver lives on the same street as I do, about a mile down the road, so once I;m back up and running the girl will have a weekly reminder of her minute of poor judgement. :driver:

Because it was an accident with criminal penalties the police will be in charge of the exchange of information.

Sorry for playing Devil Advocate, but just because she gave a insurance card to the cop doesn't mean her insurance is any good.

Case in point, I was rear ended in the rain at a stop light. The driver who hit me gave the Highway Patrol what appeared to be an up to date insurance card. Come to find out her insurance had been canceled more then a month before for failing to pay the dues. So I was stuck with a 500 dollar deductible for something that was no fault of my own. My car has still not been fully repaired, I used what I got to fix the worst damaged parts, but I still have paint damage and some scuff marks in what used to be a pristine car.

I called FHP after I found out and got ahold of the officer who took the report, his response was that it happens all the time and they dont bother going after the people. What really pissed me off is the FHP officer could care less that the girl lied to him. If I was an officer and I found out people gave me purposely false information I would make it my duty to prosecute them to the full extent of the law.
