Did the police take pictures of the scene? If they did and her insurance co. sees them they are going to give you **** for your truck sitting on top of the double yellow line.

the police did take pictures, the officer said that it will not be an issue. not saying it wont become an issue, but the report will justify it

I would condemn the tire as the car had to hit it hard, even if the apparent damage is only to the rim. Do not trust it because if the cord on the outside fails it can cause some problems for you or for the car next to you.

I would definitely inspect the bearings of that hub, and also the hub of the other axle on that side. I would also suspect the other outside tire as it most likely was hit as well, even if no damage is obvious. A large amount of lateral force was applied directly to your truck, in a very isolated area. Although the bearing may seem to be just fine, micro cracks may be present that will cause them to fail at speed.

You have to remember that enough force was dissapated to destroy her car and that force was "used up" in the collision with your truck. I have seen leaf springs broken in half on a one ton truck by an impact from a Ford Escort in a collision very similar to yours. Even with the damage the one ton drove off the street and made it to a parking lot where it could be repaired later. The escort was repairable, but was very close to being totalled.

I say all of this with no intention of advising you to gouge or otherwise take advantage of the offending driver's insurance. I am simply telling you to be completely thorough in your post accident inspection of the truck, and do not be afraid to ask for compensation to do this inspection. You are entitled to that as the result of another person's negligence.

Sorry for playing Devil Advocate, but just because she gave a insurance card to the cop doesn't mean her insurance is any good.

Case in point, I was rear ended in the rain at a stop light. The driver who hit me gave the Highway Patrol what appeared to be an up to date insurance card. Come to find out her insurance had been canceled more then a month before for failing to pay the dues. So I was stuck with a 500 dollar deductible for something that was no fault of my own. My car has still not been fully repaired, I used what I got to fix the worst damaged parts, but I still have paint damage and some scuff marks in what used to be a pristine car.

I called FHP after I found out and got ahold of the officer who took the report, his response was that it happens all the time and they dont bother going after the people. What really pissed me off is the FHP officer could care less that the girl lied to him. If I was an officer and I found out people gave me purposely false information I would make it my duty to prosecute them to the full extent of the law.


Well im gonna say that i totally agree i have had my fair share of wrecks all but one wasnt my fault i have run into the problem of people having no insurance to having my insurance pay out a total loss claim im glad to see your are all right the truck can be fixed and i defintely wish u all the best as u fix the truck and go thru the process with the insurance company hopefully by now u are settled if not i hope u come out on top God bless

By all means keep up with all your receits for what u spend on the truck i learned that so as i build this mv m1008 ill be covered just my 2 cents

I have uninsured/underinsured on my van policy. It is worth the few extra bucks to get things taken care of. After that, Allstate goes after the loser and I am sitting pretty.

Well fortunately we have mandatory uninsured/underinsured insurance in MD. Even if she doesn't have current insurance or her insurance rejects her for breaking their policy, your insurance company will still cover you without screwing with your rates. You might be out of a deductible ($100 I think). That's IF she's not covered.

By the replies posted, I think you know what stuff you need to get checked out and replaced already. Good luck with it.

I do like the idea of you purchasing her wrecked neon and parading it in the bed of the deuce for a while. What a way to add insult to injury.

in michigan they would be on a no insurance ticket quick along with about a $1000 fine ,we have $1000 a year for to years driver responsiblity fee don't pay they jerk your license but in this case it will most likly happen anyway

I can see alot of states have stricter insurance laws than TN does. In TN it is state law that you carry insurace and they will fine you and/or take you license for not having insurance. The deadbeats just drive without insurance and when they get caught, they loose their license and just continue to drive anyway (only now they don't have any license or insurance).

To top all that, the roads around here are full of illegal aliens with no license or insurance. When they get stopped or have a wreck, the cops will just turn them loose because they can't determine their identity. I've seen it happen many times, stuff that would send you or I to jail will do nothing to the illegals.

In Kansas she would be suspended for no insurance and if involved in an accident, she could not get her license back until restitution was paid, regardless of time. But like the above posted, some chose to drive drunk, suspended and uninsured. We used to have a habitual violator law that made it a felony to drive, but the state could not afford all the one year prison terms it was generating. It gets very frustrating, driving is a privilege, not a right, but the way officers get attacked by the defense, you would think driving was a God given right. I wish you the best. Glen

So step one of the process has been completed, to say I'm impressed with gulfway is an understatement, I called the 1-800 # on the back of the ins card, which then I remembered was that even though Gulfway issued the policy and thats who takes my $$, its actualy through Traveler's, within 4 hours I talked to a claims rep, an adjuster visited my house and gave me an estimate/quote for new tire, NOS rim, pulling the hub and checking the innerds plus some additional shop labor. If a problem is found within, they will issue an additional quote/work order.

Here's the catch, I have to wait for them to obtain the police report to officialy assign fault to the other party and then I can have her insurance pay for it which I need so I can avoid my $500 deductable. This will take upwards to a month to two months becuase the lovely county that I live in "has up to 30 days" to issue a police report when one is requested. I tried to obtain one yesturday as well and was told the same thing, $5, we'll give you a call in a week or two to come pick it up.

still got my fingers crossed

I'm glad to hear that Gulfway/Travelers ins has been impressive(so far) to you in your situation. I have been very impressed with them as well. I have used several of the other insurance companies that offer specialty ins, none compare to Gulfway/Travelers, in my opinion.

Please keep us updated as this proceeds.

I only have basic liability from Gulfway, so I do not expect anything from them either.

How are you going to get anything out of Gulfway if you only have liability insurance? I thought liability only pays off if you and your vehicle damage to someone's property.

Just curious. I have full coverage on mine right now.

I thought the same thing, but I guess becuase it is the other persons fault, they will cover me if her insurance will not cover me, probably a part of MD's uninsurred motorist law. I need to reread my policy. but for $170 a year, I wasn't expecting any service but I have been happy so far. They even called me today about my estimate and asked if I had any questions/concerns and if I wanted to wait to here from the other party's ins or proceed with the repairs. I'm still quite leary over the whole thing, waiting for the ball to drop, we will see.
