Issues with SF-97

Got an email today from gov planet. Demil code changed on Hemtt. They are refunding money to people who are currently waiting for approval. I called a contact at gove planet about trucks in private hands already. He said that an email will be forth coming "requesting " return of hemtts. I have not yet seen this email.
Wow. Very curious to see how the details of that play out...

Now, after receipt of that email forward them their notice that they have 3 business days to wire transfer your refund to this account or penalties will be assessed.

It's not just the refund on the purchase price, imagine all the other thousands we pour into the trucks. It's settled - they can't have my LMTV back! seriously though I kind of wonder at their legal standing here. I mean SF97, EUC, the transaction is completed. I don't see why the gov't has a legal interest anymore especially if they are retroactively changing the demil code. I mean regretting a sale was never grounds for me to get my item back. Then again, I guess I'm not the federal gov't. If only I could run my finances like they do...

If they were sold with a EUC required , the government can pretty much do what it wants as they still control it.

Week 10 still nothing. I did try to talk to DLA about my EUC but that was a no go. Updates would really help this waiting time. All these past hmmwv auctions makes you think it will bottle neck the TSC. Should be a stopping point to let the buyers get their items and then sell more. :soapbox:

After reading this... I'm thinking that my two months so far with no word isn't so bad... some have waited 5-6 months without getting anything...

They handle this like imenent domain seizures or firearm "buyback" schemes. You're required to hand it over, and they determine the compensation. In the case of MVs the compensation is typically the final bid price. So yeah, you bought the parts truck for $4250 and then put $60k into restoring it to like new, they're going to give you the $4250.

This is unrelated to EUC. They can retroactively change the demil code on any item.

They have various means of coercion to ensure compliance. Everything from coming and forcibly taking it (highly unlikely), to just revoking your title and placing you on a list of persons unable to do business with the US (highly likely).

As a general rule of thumb, you don't really *own* anything the government knows you have. You possess it at their whim, which can be changed at any moment. This applies equally to vehicles, real estate or anything else that is "registered".

Doesn't a seizure require an action on the part of the civilian government though. I mean it's one thing for congress or a state body to seize some land or property or your guns through the enactment of laws but another for the DOD to seize US civilian owned property just because they feel like it.

I am not lawyer but I feel like, given no EUC, no contract that offers to give it back, and a cleared transaction, that's a pretty good place to start fighting if you had the inclination and the lawyers. Plus they have to prove in a seizure the actual details of the public welfare benefit - eg we are taking your land so we can put a railroad or a highway on it for the betterment of all or whatever. Proving the world is a better place with HEMTTs off the road seems a bit odd. Which brings me to, I wonder why they changed their minds in the first place.

On the other hand it costs them nothing to "ask for them back" either. Maybe some people will just comply not realizing they had a recourse. I suppose there's not much point speculating until more facts are known.

I look at this way I'll lose the time and money on painting.
But they are paying truck cost and shipping or no deal.

They think they still have truck and asked how I would like my cash back.
And never once said nothing about truck.
