I struggled with this issue when getting my 5 ton registered, and I specifically put in GVWR on my title. That way, if I am ever forced to go to a weigh station, I did not want to be compared to "empty" weight and wanted to be legal up to GVWR.When you get antique plates, you no longer have a GVW weight classification, only the empty weight on the title.
If weighed at the scales, you could be consired overloaded based on the paperwork, not the actual capability of the vehicle.
The flip side is that you DO need Class B (non commercial) license. Ideally, you should get an air brake endorsement, but you do not need to take a knowledge test, only the driving test. My local PENN DOT center in Bucks County had no clue (even the supervisor), but I managed to find a sympathetic ear (inspector who had son who served and drove the trucks), so he called Harrisburg and spoke to someone who gave him this advice. The guy said to me bluntly, "it all depends who pulls you over. State Police might say one thing, truck enforcement guys another, I wish you lots of luck." Out of abundance of caution, do yourself a favor, pay the $5 for Class B learners permit and then take the driving test. This is going to give you safe harbor, in case LEO claims you are UNLICENSED to drive a 36K GVWR vehicle. God knows, we would not want the truck impounded, it would cost $800 to get it out.
